How Ally Can Help Protect Your Registry in Case of a DOL Audit

DOL

1009-K

  • 1099-Ks are sent to caregivers, providing an added layer of protection.
  • 1099-Ks sent by Ally have the Ally Tax ID number.
  • Your registry and care recipient are NOT on the 1099-K sent by Ally.

Payments and Rates

  • Flow of Funds: Ally sweeps the clients' accounts and pays the caregivers.
  • Your registry never touches the funds. In many cases, if the home care registry is not collecting and dispersing funds, the audit is concluded.
  • Caregivers and rates: The caregivers can negotiate a certain rate with a client while negotiating a different rate with another client. Likewise, a client can negotiate different rates with different caregivers.
  • WHD maintains that a registry that directs and controls the caregiver's work and sets the caregiver's rate of pay can be an employer of the caregiver. Ally ensures that your registry acts as the liaison between the caregivers and the clients without negotiating the terms and conditions of the job on either party's behalf.

Caregivers decide who to work with and when.

  • Open Shifts and CareMatch: Caregivers pick up the shifts they want to work. 
  • Open shifts available on mobile app for caregivers to pick up. You don't assign shifts, but rather caregivers choose what shifts to work.
  • Client and caregiver face sheets: Client and caregiver data is shown in a HIPAA-compliant format, available for easy download, provided to the client or caregiver. This can help them decide who to work with. It also establishes your registry as a referral business (acting as a liaison). 
  • Clock in flexibility: The mobile app allows caregivers to clock in whenever they want as they are not bound to a specific schedule set by your registry. A registry's exercise of control over the caregiver's work schedules and assignments may indicate that the registry is an employer of the caregiver.

Electronic Caregiver Onboarding

Caregivers have the autonomy of their own demographic data input, setting their availability, uploading their certifications, etc.

Support and Implementation

Ally provides continuous support to caregivers in your referral network regarding the mobile app. Your registry does not do the tech training, separating you from potentially being labeled as their employer.
